KineticRx Athletic Club – Terms & Conditions

These Terms & Conditions (“Terms”) govern your membership and use of facilities and services at KneticRx Athletic Club (“KneticRx”, “we”, “us”, or “our”). By becoming a member or using our facilities or services, you agree to be bound by these Terms, together with our Privacy Policy (https://kneticrx.com/privacy-policy)

1. Definitions & Interpretation

1. “Member” means an individual who has completed enrollment/sign-up with KneticRx and whose membership is active.

2. “Facilities” means all physical premises, equipment, amenities, classes, and services offered by KneticRx (e.g. gym floor, weight/rack area, group classes, personal training, etc.).

3. “Membership Fee” means the fee charged by KneticRx for access to Facilities, classes, or services under a membership plan.

4. “Membership Period” means the duration for which a membership is valid (e.g. monthly, quarterly, annual, or as per plan selected).

5. “Rules” means any code of conduct, health & safety rules, facility-use rules, class booking rules, posted notices, or instructions from staff.

2. Membership, Access & Use

• Membership is subject to approval by KneticRx. We reserve the right to accept or reject any membership application in our sole discretion.

• Members must be at least [insert minimum age — e.g. 16 / 18] years old (or have parental/guardian consent if younger), unless otherwise agreed by KneticRx.

• Use of Facilities and participation in services (classes, personal training, etc.) is subject to availability, scheduling, and any booking rules.

• Members must comply at all times with Rules regarding conduct, hygiene, attire, equipment use, safety, bookings, and facility use.

3. Membership Fees and Payment

• Membership Fees, payment schedule, and payment method will be as agreed at sign-up (e.g. one-time payment, monthly auto-renew, recurring direct-debit, etc.).

• KneticRx reserves the right to change Membership Fees or payment methods. Any changes will be communicated to members at least [insert notice period, e.g. 30 days] before taking effect.

• If payment method fails (e.g. insufficient funds), the member remains responsible for payment. KneticRx may suspend or terminate membership until outstanding dues are cleared.

4. Membership Duration, Renewal, Suspension, and Cancellation

• Membership is valid for the agreed Membership Period. Unless otherwise specified, memberships may renew automatically under the same terms.

• Members may cancel membership by providing written notice [insert required notice period, e.g. 30 days] before the next billing date.

• KneticRx may, at its discretion, suspend or freeze a membership (e.g. due to maintenance, closure, or special circumstances).

• Credits, extensions, or refunds for suspended periods may be offered at KneticRx’s discretion, but are not guaranteed. For prepaid or fixed-term memberships (e.g. annual, quarterly), fees are non-refundable unless otherwise agreed.

5. Health, Safety & Liability Waiver

• Members warrant that they are in good health and physically able to participate in exercise. Members agree to inform KneticRx of any medical conditions, injuries, or medications that could affect safe participation.

• Use of Facilities and participation in training or classes is at Member’s own risk. Exercise and use of gym equipment carry inherent risks, including injury or death.

• Members assume all such risks. KneticRx, its owners, staff, trainers, contractors, affiliates and agents are not liable for any injury, illness, death, or property loss or damage sustained by Members except as required by mandatory law.

• Members agree to follow all health and safety instructions, including proper use of equipment, hygiene measures (e.g. wiping down equipment, using towels), wearing appropriate attire, observing facility rules, and avoiding use if ill or contagious.

6. Conduct, Facility Use & House Rules

Members agree to:

• Respect other members, staff, equipment, and facility property.

• Use equipment properly and return it to its designated place after use.

• Maintain hygiene (clean clothes, towels, wipe equipment, use lockers, etc.).

• Not engage in abusive, threatening, or disruptive behavior toward staff or other members — such behavior may result in immediate suspension or termination of membership.

• Not share membership cards, passes or access privileges; unauthorized sharing or allowing non-members to access Facilities is prohibited and may lead to immediate termination.

• Comply with any additional posted notices, signage, or instructions from KneticRx staff.

7. Changes, Closures & Maintenance

• KneticRx may periodically close or partially restrict access to Facilities for maintenance, refurbishment, cleaning, holidays, emergencies, or other causes.

• We will endeavour, whenever reasonably possible, to provide prior notice of such closures or service disruptions.

• Members acknowledge that temporary closures or class cancellations may occur and agree that KineticRx is not obligated to provide refunds for such interruptions, unless otherwise specified.

• KineticRx reserves the right to modify class schedules, instructors, services, fees, membership plans or terms — with reasonable notice — to ensure smooth operation, compliance with law, or improvement of services.

8. Privacy, Data & Communications

• KineticRx will collect and use personal information (name, phone number, email, address, health disclosures, emergency contact, etc.) as described in our Privacy Policy to manage memberships, bookings, payments, communications, and facility operations.

• Athletic Club By becoming a Member, you consent to such collection and use of data in accordance with our Privacy Policy.

• We may use personal data to notify you about schedule changes, promotions, membership renewals, fees, closures, or other relevant communications.

• If we operate CCTV or surveillance (or plan to in the future), use and storage of footage will be governed by applicable law and will be used for safety, security, and loss prevention only.

9. Additional Services (e.g. Personal Training, Classes, Nutrition Programs)

• Additional services (such as personal training, specialized classes, nutrition coaching) may be offered by KineticRx or independent contractors.

• These services may require separate agreements and payment arrangements. The Terms herein apply only to general membership unless otherwise explicitly stated.

• KineticRx is not liable for injury, damage or loss resulting from services provided by third-party trainers, contractors or affiliates, except as required by applicable law.

10. Termination by KineticRx

KineticRx reserves the right to terminate or suspend membership immediately if:

• A Member breaches any of these Terms or facility Rules;

• A Member engages in abusive, unsafe, illegal or disruptive behavior;

• Payment obligations are not met and remain outstanding after notice;

• A Member shares membership or allows unauthorized access; or

• For any other serious reason as determined by KineticRx in its reasonable discretion.

11. Dispute Resolution, Complaints & Governing Law

• Members should raise any complaints or concerns via [insert contact method — email, phone, in-person, etc.].

• KineticRx will review and respond to complaints in a reasonable timeframe.

• These Terms are governed by the laws of the jurisdiction where KineticRx operates (currently Pakistan). Any disputes which cannot be resolved amicably will be subject to the relevant court’s jurisdiction.

 

12. Severability & No Waiver

• If any provision of these Terms is held invalid or unenforceable, that provision will be severed and will not affect the validity of any other provision.

• Failure by KineticRx to enforce any right or provision under these Terms at any time does not constitute a waiver of such right or provision.

 

13. Amendments to Terms

• KineticRx reserves the right to amend or revise these Terms at any time. Updated Terms will be published on our website and/or communicated to Members.

• Continued use of Facilities or services after the posting of revised Terms constitutes acceptance of those changes.

• If a Member does not agree to the updated Terms, the Member may cancel their membership in accordance with the cancellation provisions above.

 

14. Acknowledgment & Agreement

By signing up for membership, attending the gym or using any services of KineticRx you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy.
